1. Acceptance of terms
By accessing or using Moksy AI ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
These terms form a legally binding agreement between you (or the organisation you represent) and Moksy AI Ltd, a company registered in England and Wales.
2. Description of services
Moksy provides AI-assisted software development lifecycle (SDLC) planning tools tailored for the education sector. Services include, but are not limited to:
- AI-driven requirements gathering and documentation.
- Solution architecture generation.
- Project and team management tools.
- Subscription-based access tiers with different feature allowances.
3. Accounts and access
You must create an account to access the full Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must be at least 18 years old to create an account. By creating an account on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
4. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose.
- Attempt to gain unauthorised access to any part of the Platform.
- Reverse-engineer, decompile, or disassemble any part of the Platform.
- Use the Platform to generate content that is harmful, defamatory, or violates third-party rights.
- Resell or sublicense access to the Platform without written permission.
- Upload malicious code, viruses, or other harmful content.
5. Subscriptions and payment
Access to premium features requires a paid subscription. Subscriptions are billed in advance on a monthly or annual basis. All prices are in GBP (£) and exclusive of VAT unless stated otherwise.
Payments are processed by Stripe. By subscribing, you authorise Moksy to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period — no refunds are issued for unused portions of a subscription term.
6. Intellectual property
All content, software, trademarks, and other intellectual property on the Platform belong to Moksy AI Ltd or its licensors. You retain ownership of any data and content you submit to the Platform.
By using the Platform, you grant Moksy a non-exclusive, royalty-free licence to process your submitted content solely to provide the services described in these Terms.
7. AI-generated content
The Platform uses AI models to generate requirement documents, architecture suggestions, and other outputs. Such outputs are provided for informational purposes only. Moksy does not guarantee the accuracy, completeness, or fitness for purpose of AI-generated content. You are solely responsible for reviewing and validating any AI-generated output before relying on it.
8. Limitation of liability
To the fullest extent permitted by law, Moksy's total liability for any claim arising from use of the Platform shall not exceed the amount you paid to Moksy in the 12 months preceding the claim.
Moksy is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
